Transparency Report: Federal Court accepts AGU request and upholds publication obligation

Following the granting of an injunction requiring companies to disclose the transparency reports provided for in the Equal Pay Act, the Federal Government, through the Federal Attorney General’s Office (AGU), managed to have the decision suspended.

The AGU, in defense of the legislation, argued that the rules were drawn up with the participation of business confederations and that there is no kind of violation of personal data or undue exposure, given that individual salaries are not disclosed, but only the percentage difference in the amounts paid.

The President of the Federal Regional Court of the 6th Region, in granting the AGU’s request, stated :

In addition, the reverse periculum in mora is present, reflected in the damage that society as a whole would have to endure by having legislation that is vital to combating systemic inequality and protecting women’s rights removed”
