Claro’s Acquisition of Desktop Raises Market Concentration and Regulatory Concerns in the Telecommunications Sector

The telecommunications market is closely following the developments surrounding the potential acquisition of Desktop by Claro, a company controlled by Mexico’s América Móvil. The transaction has the potential to strengthen Claro’s infrastructure and expand its customer base, but it also raises concerns regarding regional concentration and competitive impacts.

According to Rafael Pistono Vitalino, partner at PDK Advogados and a specialist in Regulatory Law, “if completed, the acquisition of Desktop by Claro will require a more detailed analysis by CADE. In addition, the transaction would likely attract significant interest from competitors, as indicated by the movements of smaller provider associations that have joined concentration proceedings before the council as third parties,” says the partner at PDK Advogados.

The case underscores the importance of a technical and preventive approach to M&A operations in regulated sectors, particularly those involving essential infrastructure and regional competition.

At PDK Advogados, we advise companies and economic groups on concentration processes, antitrust analysis, and telecommunications regulation, with a focus on governance, compliance, and strategic efficiency.
